CONDIZIONI GENERALI DI VENDITA

1. Questa è un’asta pubblica condotta da Artemide Aste S.r.l. La possibilità di parteciparvi e/o conferire materiale è soggetta a nostra discrezione.
2. Il prezzo di aggiudicazione è soggetto a un diritto d’asta del 20%.
3. Tutti gli oggetti in vendita sono aggiudicati al miglior offerente dal Direttore d’Asta. A tutela degli acquirenti, non sono accettate commissioni del tipo “offerta illimitata”.
4. Il pagamento dei lotti aggiudicati deve avvenire entro 7 giorni dall’emissione della fattura. Fino al saldo integrale, gli oggetti restano di proprietà del conferente. Il mancato pagamento nei tempi previsti può comportare l’annullamento dell’ordine.
5. I partecipanti all’asta devono fornire al Direttore d’Asta tutte le informazioni necessarie alla loro identificazione prima dell’inizio dell’asta. A discrezione del Direttore d’Asta, potrà essere richiesto un deposito cauzionale pari al 25% delle offerte previste; l’importo non utilizzato sarà rimborsato integralmente al termine dell’asta. Tutte le offerte devono essere firmate. Le offerte inviate in forma cartacea (lettere e fax) devono essere firmate a mano per essere considerate valide. Le presenti regole si applicano anche a chi partecipa per posta o in via elettronica. Per alcune aste potrà essere predisposto un "credito" associato al cliente, che definisce il massimo importo complessivo che lo stesso potrà spendere nel corso dell’asta. Superato tale limite, l’accettazione delle offerte da parte del cliente non è garantita.
6. Le offerte devono riferirsi ai lotti secondo la numerazione del catalogo. L’asta si svolge secondo l’ordine del catalogo, ma Artemide Aste S.r.l. si riserva il diritto di modificarlo. Artemide Aste S.r.l. non è responsabile per errori nell’aggiudicazione: vi invitiamo a verificare attentamente il numero di lotto e l’importo massimo offerto. Faremo ogni sforzo per registrare correttamente le offerte ricevute per email o tramite portali online, ma non possiamo garantire l’infallibilità del servizio.
7. Ogni lotto ha un prezzo di base. I lotti possono essere venduti al prezzo base o superiore. Offerte inferiori al prezzo base non saranno accettate.
8. Artemide Aste S.r.l. si riserva il diritto di ritirare, dividere o accorpare lotti, per qualunque motivo ritenuto opportuno.
9. Tutti i lotti si intendono autentici salvo indicazione contraria, sulla base delle valutazioni dei nostri esperti. Eventuali reclami devono pervenire entro 7 giorni dal ricevimento del lotto (fa fede il timbro postale). I lotti devono essere restituiti nelle stesse condizioni in cui sono stati inviati, senza apertura di confezioni sigillate. Non si accettano resi senza consenso preventivo. Non si accettano contestazioni oltre 30 giorni dalla chiusura dell’asta. La restituzion di lotti multipli non è ammessa.
10. L’attribuzione e la classificazione dei lotti riflettono l’opinione soggettiva dei nostri esperti e non costituiscono garanzia. Anche il grado di conservazione è soggettivo. Il termine “Proof”, “Specimen” o “Prova” indica la tecnica di coniazione, non lo stato di conservazione. Gli aggettivi descrittivi non costituiscono parte vincolante della descrizione.
11. Questa è una vendita all’asta, non una vendita diretta. I partecipanti rinunciano al diritto di recesso previsto per le vendite a distanza. I lotti possono essere visionati prima dell’asta. Gli esperti sono disponibili per chiarimenti. Si invita a chiarire ogni dubbio prima della partecipazione. Artemide Aste S.r.l. agisce come semplice intermediaria tra il conferente e l’acquirente; ogni vendita deve pertanto considerarsi conclusa direttamente tra queste due parti. Di conseguenza, ogni obbligazione connessa alla vendita (autenticità, provenienza, stato di conservazione, ecc.) ricade in ultima istanza sul conferente. In caso di richiesta di risarcimento danni o azione di rivalsa, la responsabilità di Artemide Aste S.r.l., in qualità di intermediaria, è in ogni caso limitata all'importo della propria commissione percepita sulla vendita del lotto contestato.
12. Le offerte per corrispondenza o via email/fax sono accettate da chi non può partecipare di persona o elettronicamente. Devono essere espresse in Euro e pervenire prima della chiusura dell’asta. L’offerta più alta si aggiudica il lotto. Se l’offerta più alta è pervenuta per corrispondenza, il lotto sarà aggiudicato con un incremento massimo come da tabella rilanci rispetto alla seconda offerta. In caso di offerte uguali, prevale quella ricevuta per prima. Le offerte in sala o online hanno precedenza su quelle per corrispondenza.
13. Artemide Aste S.r.l. si riserva il diritto di rifiutare offerte da soggetti ritenuti inaffidabili o non in buona fede. In caso di asta con presenza in sala, chi disturba il regolare svolgimento dell’asta può essere allontanato.
14. Le fotografie in catalogo rappresentano i lotti effettivi. Misure e pesi sono indicativi e non costituiscono motivo valido per l’annullamento dell’acquisto.
15. Le spese di spedizione, assicurazione ed eventuali tasse sono a carico dell’acquirente.
16. Artemide Aste S.r.l. può richiedere il pagamento anticipato prima della spedizione. I lotti viaggiano a rischio e spese dell’acquirente, che è responsabile del ritiro e dell’eventuale assicurazione.
17. Trascorsi 30 giorni dalla chiusura dell’asta senza pagamento, Artemide Aste S.r.l. può annullare l’aggiudicazione e rimettere in vendita il lotto. In tal caso, l’aggiudicatario è tenuto a pagare i diritti d’asta e l’eventuale differenza tra il prezzo originario e quello della nuova aggiudicazione.
18. Artemide Aste S.r.l. si riserva il diritto di anticipare o posticipare la data dell’asta in caso di eventi che possano comprometterne il corretto svolgimento.
19. Presentando un’offerta, l’acquirente si impegna personalmente al pagamento, anche se agisce per conto terzi. Se l’offerta proviene da una società, l’amministratore si impegna personalmente. Fax e lettere devono essere firmati.
20. Artemide Aste S.r.l. può presentare in asta propri lotti. I conferenti possono partecipare all’asta e riacquistare i propri lotti, pagando la commissione e le eventuali spese.
21. Qualora Artemide Aste S.r.l., per qualsiasi motivo, non fosse in grado di far pervenire i lotti all’acquirente, l’importo pagato sarà integralmente rimborsato. In qualità di intermediaria, Artemide Aste S.r.l. non può essere ritenuta responsabile per danni indiretti o conseguenti al mancato recapito.
22. Il materiale acquistato può essere trattenuto a garanzia del saldo degli importi dovuti.
23. È illegale accordarsi per turbare l’asta al fine di aggiudicarsi lotti da ridistribuire in un’“asta privata”.
24. Ogni controversia è regolata dalla legge della Repubblica di San Marino. Foro competente: Tribunale della Repubblica di San Marino.
25. La partecipazione all’asta comporta l’accettazione integrale delle presenti condizioni.
26. In caso di divergenze tra versioni linguistiche, fa fede la versione italiana.

GENERAL TERMS AND CONDITIONS OF SALE

1. This is a public auction conducted by Artemide Aste S.r.l. Participation and/or the consignment of material is subject to our discretion.
2. The hammer price is subject to a 20% buyer’s premium.
3. All items offered for sale are awarded to the highest bidder by the Auctioneer. To protect buyers, “unlimited bids” will not be accepted.
4. Payment for lots awarded must be made within 7 days of the invoice date. Until full payment is received, items remain the property of the consignor. Failure to pay within the deadline may result in cancellation of the order.
5. Participants must provide the Auctioneer with all necessary identification information before the start of the auction. At the Auctioneer’s discretion, a deposit equal to 25% of the expected bids may be requested; any unused amount will be fully refunded at the end of the auction. All bids must be signed. Bids submitted in paper form (letters and faxes) must bear a handwritten signature to be considered valid. These rules also apply to those participating by mail or electronically. For certain auctions, a "credit limit" may be assigned to a client, representing the maximum total amount they may spend during the auction. Once this limit is reached, the acceptance of further bids from that client is not guaranteed.
6. Bids must refer to the lot numbers in the catalogue. The auction will proceed in catalogue order, although Artemide Aste S.r.l. reserves the right to modify it. Artemide Aste S.r.l. is not responsible for errors in bidding: please check carefully the lot number and the maximum amount you are willing to bid. We will do our best to correctly register bids submitted via email or online platforms, but we cannot guarantee the infallibility of this service.
7. Each lot has a starting price. Lots may be sold at or above the starting price. Bids below the starting price will not be accepted.
8. Artemide Aste S.r.l. reserves the right to withdraw, divide or combine lots, for any reason deemed appropriate.
9. All lots are considered authentic unless otherwise stated, based on the assessments of our experts. Any claims must be made within 7 days of receipt of the lot (postmark will serve as proof). Lots must be returned in the same condition in which they were sent, without opening sealed packaging. Returns will not be accepted without prior consent. Claims submitted more than 30 days after the close of the auction will not be accepted. The return of multiple-lot groupings is not permitted.
10. The attribution and grading of lots reflect the subjective opinion of our experts and do not constitute a guarantee. Grading is also subjective. The terms “Proof,” “Specimen,” or “Prova” refer to the method of striking, not the state of preservation. Descriptive adjectives are not binding and are not part of the official lot description.
11. This is an auction sale, not a direct sale. Bidders waive the right of withdrawal applicable to distance sales. Lots may be viewed prior to the auction. Our experts are available for clarification. Bidders are encouraged to clarify any doubts before participating.
Artemide Aste S.r.l. acts solely as an intermediary between the consignor and the buyer; each sale must therefore be considered as concluded directly between these two parties. Consequently, any obligation relating to the sale (authenticity, provenance, condition, etc.) ultimately lies with the consignor.
In case of any claim for damages or legal action for compensation, the liability of Artemide Aste S.r.l., as an intermediary, is in any case limited to the amount of its commission received on the contested lot.
12. Absentee bids sent by mail, email, or fax are accepted from those unable to participate in person or online. Bids must be expressed in Euro and received before the auction closing date. The highest bid wins the lot. If the highest bid is received by correspondence, the lot will be awarded with a maximum increment in accordance with the bidding steps table. In case of equal bids, the earliest received will prevail. Bids made in the room or online take precedence over absentee bids.
13. Artemide Aste S.r.l. reserves the right to refuse bids from parties deemed unreliable or not acting in good faith. In the case of in-room auctions, anyone disrupting the proper conduct of the auction may be removed.
14. The photographs in the catalogue represent the actual lots. Dimensions and weights are approximate and not grounds for cancellation of purchase.
15. Shipping, insurance, and any applicable taxes are the responsibility of the buyer.
16. Artemide Aste S.r.l. may request payment in advance before shipping. Lots travel at the buyer’s risk and expense. The buyer is responsible for arranging collection and optional insurance.
17. If payment is not received within 30 days of the auction close, Artemide Aste S.r.l. may cancel the sale and reoffer the lot. In such case, the buyer is still liable for the buyer’s premium and any difference between the original and the resale price.
18. Artemide Aste S.r.l. reserves the right to bring forward or postpone the auction date if events arise that may affect the auction's proper conduct.
19. By submitting a bid, the bidder personally guarantees payment, even if acting on behalf of a third party. If the bid is submitted on behalf of a company, the company’s administrator personally guarantees payment. Faxes and letters must be signed.
20. Artemide Aste S.r.l. may offer its own lots in the auction. Consignors may bid on and repurchase their own lots, paying the standard commission and any applicable fees.
21. If Artemide Aste S.r.l., for any reason, is unable to deliver lots to the buyer, the amount paid will be fully refunded. As an intermediary, Artemide Aste S.r.l. cannot be held liable for indirect or consequential damages due to non-delivery.
22. Purchased lots may be retained by Artemide Aste S.r.l. as security for payment of outstanding balances.
23. It is illegal and punishable by law to collude with others to disrupt the proper conduct of the auction in order to acquire lots and later dispute them in a “private auction.”
24. Any dispute arising from the auction is governed by the laws of the Republic of San Marino. The competent court is that of the Republic of San Marino.
25. Participation in the auction implies full acceptance of these terms and conditions.
26. In the event of discrepancies between language versions, the Italian version shall prevail.
